Diese sollte zu einem ganzheitlichen, interdisziplinar informierten Auslegungsansatz fortentwickelt werden: Rechtsokonomische, demokratie- und integrationstheoretische Erwagungen mussen dabei mit (unions-)verfassungsrechtlichen, entstehungsgeschichtlichen und systematisch-grammatischen Auslegungsgesichtspunkten sowie der (inkonsistenten) "Fallrechtsprechung" des Europaischen Gerichtshofs versohnt werden. Als zentrale Leitlinie fur die Auslegung der Grundfreiheiten erweist sich der Grundsatz der Wettbewerbsgleichheit. Mit diesem Grundsatz ist die Marginalisierung von Art. 35 AEUV in der Rechtsprechung des EuGH nicht vereinbar. Warenexporteure sollten (unter bestimmten Bedingungen) das aus der Warenausfuhrfreiheit abgeleitete Recht besitzen, die Rechtsnormen ihrer Sitzstaaten "abzuwahlen" und diese durch EU-auslandische Rechtsnormen zu "ersetzen".
