Als zentrale Leitlinie fur die Auslegung der Grundfreiheiten erweist sich der Grundsatz der Wettbewerbsgleichheit. Mit diesem Grundsatz ist die Marginalisierung von Art. 35 AEUV in der Rechtsprechung des EuGH nicht vereinbar.
