Smith war nicht nur Wirtschaftstheoretiker, der die zentrale Rolle des Marktes betonte, sondern auch Moralphilosoph. Der schottische Denker entdeckte, dass der Markt manchmal zu Konsequenzen führt, die besser sind als die egoistischen Absichten der Menschen. Doch das ist keineswegs immer der Fall. Manchmal folgt aus Gutem auch Schlechtes, etwa unbeabsichtigte negative ökologische Folgen. Deshalb plädierte Smith dafür, der Unsichtbaren Hand des Marktes unter bestimmten Umständen "in den Arm zu fallen". Das ist dann die Sichtbare Hand des Staates, etwa durch aufgeklärte Bildung und Arbeiterschutz. Auch das Bild des Privatmanns Smith ist korrekturbedürftig. Er gilt als sauertöpfisch und sehr professoral. Wahr ist hingegen, dass er überaus empathisch, wohlwollend und freigiebig war und zudem zeitlebens ein ziemlich hitziges Gemüt besaß.

Their principal contracting partners are ship builders and ship owners. Increasingly, classification societies are being faced with damage claims initiated by members of the shipping industry with whom they have not established a contractual relationship. Under German law but in a comparative perspective, Jurgen Basedow and Wolfgang Wurmnest examine such third party claims. They focus in particular on how such claims are affected by limitation of liability clauses agreed upon between the classification society and its contracting partners.
