The performance of tertiary educational institutions is heavily influenced by their governance arrangements, management structures, accountability mechanisms, and regulatory environments. 'Legal Frameworks for Tertiary Education in Sub-Saharan Africa' analyzes 70 examples of tertiary education legislation and individual statutes of selected public institutions in 24 Sub-Saharan African countries. The idea that developing all sectors of the educational palette is influential for socio-economic development was adopted later in Sub-Saharan Africa than in other world regions. Most efforts went primarily into developing the first stages of education, and rightly so, for many children could not access education at all. Today, all African governments recognize the importance of higher education and increasingly invest in it. They are facing two major, interlinked challenges: rapid population growth and decline in the quality of education. Indeed, despite fertility decline, the region has been confronted with substantial population growth, which will continue for many decades; as such, there is a necessity to increase investment in education. This, in a situation of limited resources, has been at the expense of the quality and the burgeoning of private institutions of higher education. The contributions here discuss the development, quality, and outcomes of higher education in Africa, with a specific focus on relations between Africa and Europe. The evaluation finds that the content of the World Bank s Country Policy and Institutional Assessment (CPIA) is largely relevant for growth and poverty reduction in the sense that it maps well with the determinants of growth and poverty reduction identified in the economics literature. However, some CPIA criteria need to be revised (in particular trade and finance), and one needs to be added (assessment of disadvantaged socio-economic groups). Second, the evaluation finds that the CPIA ratings are in general reliable and correlate well with similar indicators. The World Bank s internal review process helps guard against potential biases in having Bank staff rate countries on which their work programs depend. The CPIA ratings are found to correlate better with similar indicators for middle income countries than for low income countries. This could be because there is more information available on middle income countries, which increases the likelihood of different institutions having similar assessments on them. This could also be because the CPIA rating exercise takes into account the stage of development, which is more pertinent for low income countries, and which also subject the ratings of those countries to more judgment in an exercise that is already centered on staff judgment.

Governments around the world, and particularly those in developing countries, face significant educational challenges. Despite progress in raising education enrollments at the basic education level, much remains to be done. Today, about 77 million children in developing countries are not in school, particularly in Sub-Saharan Africa and South Asia. Higher education participation rates remain low in many developing countries, and public higher education institutions (HEIs) struggle to absorb growing numbers of secondary school graduates. Public universities face ongoing challenges, including a lack of teaching and research resources, and the loss of qualified staff to developed countries. The inability of public sector educational institutions, particularly in developing countries, to absorb growing numbers of students at all levels of education has seen the emergence of private schools and HEIs. This paper briefly examines the international experience concerning the regulation of private education at the school and higher education level. It begins with an overview of the private school and higher education sectors and a short discussion of the potential benefits of increased private participation in education. The remainder of the paper focuses on the following questions and sets out propositions for governments to consider.
