The popularity of his monumental and definitive works established Shabtai Rosenne as the undisputed expert on the International Court of Justice's law and practice of his time. Irrefutably the leading work on the court, previous editions of "Rosenne's Law and Practice of the International Court" have influenced generations of legal scholars, practitioners, judges, and students alike. The Fifth Edition, by Malcolm N. Shaw, combines his expertise as both an academic and practitioner to bring this monumental resource up-to-date while retaining Rosenne's distinctive voice, erudition, and rigorous objectives. Preserving Rosenne's focus on the caselaw of the court, the Fifth Edition is supplemented with increased references to the leading academic literature, and, like the Fourth Edition, is divided into four substantive volumes.

Kluwer Law International is proud to announce the publication of the Third Edition of Shabtai Rosenne's monumental & definitive work on The Law & Practice of the International Court. The First Edition was published in 1957, & was followed not only by the Second Edition, in 1965, but also by another definitive writing on the Court by Rosenne, which have established him as the undisputed expert on the Court's law & practice. The fiftieth anniversary of the United Nations & of the International Court of Justice provided the author with the opportunity & the incentive to re-examine what he had written about the Court. He had a wide exchange of correspondence & many conversations with Members of the Court & its Registrars, as well as with other friends who know the Court & its practices well. This led him to undertake a major reconstruction of the work, which is now divided into three substantive volumes together with an index volume. Volume I deals with the Court as one of the principal organs, & the principal judicial organ, of the United Nations. Diplomats & legal advisers who have to deal with matters relating to the Court on a political level, in different organs of the United Nations & in other offices, will find here a full discussion of the diplomatic, political & administrative aspects of the Court's affairs. Volume II deals exclusively with jurisdiction & the treatment of jurisdictional matters by the Court. These aspects occupy a prominent place in the Court's affairs. New forms of testing the jurisdiction of the Court have appeared & introduced serious complications into the practices, techniques & tactics of the judicial settlement of international disputes through the International Court. This volume also includes the Court's advisory jurisdiction: the advisory work has related to very difficult legal issues in matters of major political import. Volume III is devoted exclusively to the Court's procedure. This is now a completely autonomous branch of international law, & has severed its ties with internal litigation & with classical international arbitration as embodied in the Hague Conventions of 1899 & 1907. A major change of presentation here is the chapter on the Bench. The Court has made a very sharp distinction between the Court itself, that is the judges elected in accordance with the Statute, & the Bench, that college of magistrates who hear & decide a given case. It avoids confusion to deal with the Bench as a matter of procedure in the conduct of a case, separate from anything to do with how the Members of the Court come to occupy their position, & what their role is. This way of presenting the material also brings out the dual functions of the President of the Court & the President of the Bench. Volume IV contains the English text of the Charter of the United Nations, the Statute of the Court & the 1978 Rules of Court, together with a full set of indexes. The Third Edition of The Law & Practice of the International Court is an essential component of all International Law Libraries & an indispensable work for all those practising in the field of International Law.
